Michigan Title IX challenge

The public page describes a closed Michigan Title IX lawsuit for the Great Education Initiative. It says the matter ended in a settlement after the federal rule was rescinded.

The live page opens with a thank-you and calls the outcome a victory. It says Five Stones Legal Defense Fund filed federal litigation for the Great Education Initiative challenging the federal government’s redefinition of Title IX in Michigan schools. It says the suit raised First Amendment rights, sharing of intimate spaces, and the major-questions doctrine. It says that after this litigation and other multi-state challenges, the federal government rescinded and vacated the Title IX rules, and that the lawsuit then settled with the federal government agreeing to pay attorney fees.

Summary on the public page

The page says the Department of Education’s Title IX rule expanded the sex-discrimination ban to sexual orientation and gender identity. It says the rewrite drew at least nine lawsuits, that at least 26 states signed on, and that the rule was on hold in 26 states. It says the Great Education Initiative’s Michigan case is a private lawsuit, not an attorney-general lawsuit, in a state where no other challenge to the final rule had been brought.

The page also says the lawsuit challenges a federal rule that requires public schools to discipline parents and students for sexual-orientation and gender-identity discrimination, and that the rule heightens disputes over bathrooms, locker rooms, and sports. It says the private suit pursues damages under the Religious Freedom Restoration Act, beyond the attorney-general suits.

The projects list on the live site marks Title IX closed.
